Elements Matchmaker Terms of Service
The terms “Member” and “Client” are used to describe anyone in good standing with Elements, Matchmaker, with an active profile listed in our database.
Elements, Matchmaker may be hereafter referred to as “we”, “us”, “our”, I and “I’m”.
Elements offers matchmaking services to adult men and women aged 18 and over. We reserve the right to deny access to anyone at any time for any reason, without explanation. Elements reserves the right to cancel any membership at any time, for any reason, without explanation including, but not limited to, any member providing false information.
Premier members understand and agree that if they receive a match offer with an Elite member, they will be asked to answer additional screening questions in order to accept the match, and may decline, therefore declining the match offer.
Members agree that Elements Matchmaker is constantly growing and that services and pricing may be updated and are subject to change at any time, for any reason, without notice, and members have the option to decline any match offer if they don’t wish to pay the current match fee.

Accepted matches are defined as matches that have been accepted by both members, and who’s payments for that match have been fully processed.
Members agree that once a match has been accepted by both parties, and payment has been completed, there are no refunds.
Members understand that, with all good intentions, Elements' goal will be to attempt to match members who we feel have a good likelihood of building a relationship together. Members understand and agree that the database is constantly changing and that no guarantees shall be made or implied that Elements, Matchmaker will be able to locate a suitable match.
Members agree that no timeframe for receiving a compatible match are given or implied by Elements.
Members agree that Elements will coordinate all first meetings. Though we are happy to work with the members on the details, including time, date and location, Elements will be engaged in the process to the extent necessary to ensure that the first meeting takes place, and at least one follow up communication is completed.
Elements will make up to 3 attempts to work with the availability of the members to successfully complete the first meeting. If either or both members have to reschedule, cancel or otherwise miss the first meeting, and the first meeting is not completed after 3 attempts by Elements, members agree to hold Elements free of all obligation to attempt resetting the first meeting.
At that time, both members may choose to have their contact information shared so they may pursue a first meeting independently, but must provide feedback on the first meeting before being permitted to accept any further matches.
If any member continuously cancels, resets, changes, ghosts, is unreachable, disappears without contact or reasonable cause, or is considered by elements to be habitually difficult in terms of committing to a first meeting, causing failure of the first meeting to occur, Elements may choose to place the members profile on hold for 30 days, or to cease matching the member indefinitely. If such a situation occurs, Elements may, at its sole discretion, refund the match fee for the opposite, and abiding member.

Members agree to participate in at least one (1) follow up communication after each and every first meeting. Elements commitment to quality customer care depends on our members feedback, so we take great interest in knowing the actions and outcomes of all first meetings. Follow up communication shall consist of an email, and any member unwilling to provide feedback after any first meeting, agrees that their profile may be placed on hold until this communication is complete.
Members agree to strictly adhere to the following code of conduct whenever interacting in any way, with any and all matches provided to you by Elements, Matchmaker: Members will behave with common courtesy and civility, conduct themselves in an ethical and appropriate manner, exercise consideration and respect in speech and actions, engage in fair, open-minded, and principled interactions, act in good faith, and be personally accountable for individual actions.​

I AGREE THAT TO BECOME A REGISTERED USER OR MEMBER OF ELEMENTS, MATCHMAKER, TO RECEIVE MATCHES, GO ON FIRST MEETINGS OR COMMUNICATE IN ANY WAY WITH A MATCH PROVIDED TO ME BY ELEMENTS MATCHMAKER, THAT ALL INFORMATION PROVIDED BY ME DURING THE REGISTRATION PROCESS, AND ALL FUTURE COMMUNICATIONS WITH ELEMENTS, IS TRUE, FACTUAL AND COMPLETE TO THE BEST OF MY KNOWLEDGE. I AGREE THAT IF ANY INFORMATION PROVIDED BY ME CHANGES, I WILL NOTIFY ELEMENTS OF ALL CHANGES IMMEDIATELY.

I AGREE THAT I HAVE NOT BEEN CONVICTED OF ANY SERIOUS CRIMES AGAINST ANOTHER PERSON. I AGREE THAT IF ANY INFORMATION PROVIDED BY ME IS DISCOVERED TO BE UNTRUE, OR IF INFORMATION ABOUT ME IS DISCOVERED THAT COULD POTENTIALLY CAUSE HARM TO ANOTHER, ELEMENTS MAY TERMINATE MY MEMBERSHIP IMMEDIATELY, WITHOUT NOTICE.​

I AGREE THAT ELEMENTS, MATCHMAKER IS AGREEING ONLY TO ATTEMPT TO LOCATE A MATCH WHO MAY OR MAY NOT BE COMPATIBLE WITH ME, FOR THE PURPOSE OF SETTING UP A FIRST MEETING. I AGREE THAT ELEMENTS IS PERFORMING THIS SERVICE IN GOOD FAITH, WITH GOOD INTENTIONS, AND I RELEASE ELEMENTS FROM ALL LIABILITY IF ANY MATCH FAILS OR TERMINATES AT ANY TIME, FOR ANY REASON, UNDER ANY CIRCUMSTANCES.

I AGREE THAT ELEMENTS MAY DISCLOSE PERSONAL INFORMATION ABOUT ME ONLY FOR THE PURPOSE OF MATCHING ME WITH INDIVIDUALS WHO’S PROFILE INFORMATION APPEARS TO POTENTIALLY BE COMPATIBLE WITH MY OWN PROFILE INFORMATION, INCLUDING IMAGES, PROFILE DETAILS AND CONTACT INFORMATION.
I UNDERSTAND THAT ELEMENTS, MATCHMAKER DOES NOT PERFORM ANY BACKGROUND CHECKS ON ITS MEMBERS AND MAKES NO REPRESENTATION OR GUARANTEES, EITHER EXPRESSED OR IMPLIED REGARDING THE INFORMATION OR ACCURACY OF ANY POTENTIAL MATCH OR THEIR PROFILE INFORMATION. I AGREE THAT ELEMENTS DOES NOT VERIFY THE VALIDITY OF ANY MEMBER OR CLIENT INFORMATION AND THAT ELEMENTS, MATCHMAKER IS ACTING ON MY BEHALF, IN GOOD FAITH. I AGREE THAT I HAVE THE RIGHT AND RESPONSIBILITY TO CONDUCT MY OWN SCREENINGS ON ANY AND ALL MATCHES THAT I MEET THROUGH THIS SERVICE. I RELEASE ELEMENTS MATCHMAKER AND IT’S EMPLOYEES, ASSOCIATES AND FAMILY MEMBERS FROM ANY AND ALL LIABILITY.
I AGREE THAT SUBMITTING MY PERSONAL INFORMATION INTO THE ELEMENTS DATABASE DOES NOT GUARANTEE THAT ELEMENTS WILL LOCATE OR PRESENT ME WITH ANY MATCHES AT ANY TIME, NOW OR IN THE FUTURE.
I AGREE THAT THE IN PERSON MEETING FEE OF $99 MUST BE PAID FOR ME TO BEGIN ACCEPTING MATCHES, AND DOES NOT GUARANTEE THAT ELEMENTS WILL LOCATE A POTENTIAL MATCH FOR ME. I AGREE THAT THIS FEE IS NON REFUNDABLE.
I AGREE THAT I AM RESPONSIBLE FOR MY ACTIONS WHEN INTERACTING WITH ANYONE I MEET AS A RESULT OF MY PARTICIPATION WITH ELEMENTS, MATCHMAKING AND THAT DURING ALL INTERACTIONS WITH ANYONE I MEET THROUGH THIS SERVICE, I WILL BEHAVE IN ACCORDANCE WITH ALL LAWS, BOTH STATE AND LOCAL.
I AGREE TO STRICTLY ADHERE TO THE FOLLOWING CODE OF CONDUCT WHENEVER INTERACTING IN ANY WAY, WITH ANY MATCHES PROVIDED TO ME BY ELEMENTS, MATCHMAKER: I WILL BEHAVE WITH COMMON COURTESY AND CIVILITY, CONDUCT MYSELF ETHICALLY AND APPROPRIATELY, EXERCISE CONSIDERATION AND RESPECT IN SPEECH AND ACTIONS, ENGAGE IN FAIR, OPEN-MINDED, AND PRINCIPLED INTERACTIONS, ACT IN GOOD FAITH, AND BE PERSONALLY ACCOUNTABLE FOR MY ACTIONS.
